Shutter8 Media Booking Terms & Conditions

By booking, purchasing, submitting payment, or otherwise reserving services with Shutter8 Media ("Shutter8," "we," "us," or "our"), the customer ("Client," "you," or "your") agrees to the following Terms & Conditions.

1. Booking & Reservation A booking is not considered confirmed until all required booking information has been submitted, these Terms & Conditions have been accepted, and the required deposit/retainer or full payment has been successfully received. Submitting an inquiry, requesting a date, or discussing availability does not reserve a date or time. Dates and times are booked on a first-paid, first-confirmed basis. 2. Deposits / Booking Retainers Any deposit or booking retainer required to reserve a service is non-refundable, except when Shutter8 cancels the booking and is unable to provide a reasonable replacement or rescheduling option. The booking payment compensates Shutter8 for reserving the date and time, turning away other potential bookings, administrative work, scheduling, preparation, and other work associated with the reservation. The amount and remaining balance due will be shown to the Client before checkout. Failure to pay the remaining balance by the required deadline may result in cancellation of the booking. Any legal requirements that cannot be waived under applicable law will continue to apply. 3. Cancellations by Client If the Client cancels a confirmed booking, the booking deposit/retainer will not be refunded. Any additional amounts already paid will be handled according to the cancellation policy displayed for the specific service or package. Cancellation requests must be submitted through the Client's Shutter8 account or through another approved written method provided by Shutter8. Failure to appear for an appointment without proper cancellation may be treated as a no-show. 4. Rescheduling Rescheduling is subject to availability and Shutter8's current rescheduling policy. Shutter8 may establish a minimum notice period for rescheduling. Bookings rescheduled with sufficient notice may have eligible payments transferred to the new date at Shutter8's discretion and according to the applicable package policy. Repeated rescheduling, last-minute rescheduling, or failure to reschedule within the permitted timeframe may result in loss of the booking deposit/retainer. A new deposit may be required to reserve another date. 5. Late Arrivals Clients are responsible for arriving on time. A late arrival does not automatically extend the scheduled booking. Shutter8 may shorten the service to remain on schedule for other clients. If the Client is significantly late, Shutter8 may treat the booking as a cancellation or no-show. Any applicable late-arrival grace period should be displayed with the specific service. 6. Shutter8 Scheduling & Buffer Time Shutter8 reserves the right to create reasonable setup, travel, cleanup, preparation, and rest periods before or after bookings. These internal scheduling buffers do not increase the Client's purchased service time. 7. Client Cooperation The Client agrees to reasonably cooperate during the service. Shutter8 is not responsible for reduced results caused by circumstances outside its reasonable control, including: Client lateness; uncooperative participants; children or guests who refuse to participate; failure to follow preparation instructions; venue restrictions; poor venue conditions; weather; prohibited equipment; lack of access to a location; Client-provided incorrect information. 8. Location, Venue & Permissions Unless specifically agreed otherwise, the Client is responsible for obtaining any permission required to photograph, film, perform, operate a Photo Booth, DJ, or otherwise provide services at the selected location. The Client is responsible for informing Shutter8 of venue rules, parking requirements, access restrictions, permits, insurance requirements, and other relevant conditions before the event. Unexpected parking, toll, travel, permit, access, or venue charges may be billed to the Client when applicable. 9. Photography & Videography Results The Client understands that photography and videography involve artistic judgment. Shutter8 controls its creative process, including composition, lighting, selection, editing, color treatment, cropping, and final presentation unless otherwise agreed in writing. Examples shown in Shutter8's portfolio are representative of style but do not guarantee identical results for every project. 10. Image Selection For packages requiring the Client to select images for editing, the Client must submit selections through the designated Shutter8 gallery or selection system. The Client is responsible for selecting the correct images. Once editing begins, replacement selections may require an additional fee. 11. RAW / Unedited Files Unless specifically included in the purchased package or agreed to in writing, Shutter8 is not required to provide RAW camera files, project files, working files, layered editing files, or other production source files. Final deliverables consist only of the files included with the purchased service. 12. Editing & Revisions Editing packages include only the amount of editing or revision work described in the selected package. Additional retouching, revisions, image manipulation, special effects, advanced compositing, or changes beyond the included scope may require an additional fee. 13. Turnaround Times Any estimated delivery time displayed on the website or provided by Shutter8 is an estimate unless specifically identified as a guaranteed delivery deadline. Delivery times may be affected by workload, number of images, requested revisions, technical issues, holidays, client delays, or project complexity. Shutter8 will make reasonable efforts to deliver work within the stated timeframe. 14. Client Gallery & File Retention - IMPORTANT Shutter8 may provide photographs and final files through a private online Client Gallery. Unless a different retention period is specifically stated for the Client's project, Shutter8 guarantees online gallery availability for up to twelve (12) months from the date the gallery is first delivered or published. After that period, Shutter8 may archive or permanently delete proof images, unselected images, online gallery files, downloads, project copies and associated temporary files without further obligation to maintain them. CLIENT IS RESPONSIBLE FOR BACKING UP DELIVERED FILES. Once final images or other deliverables are made available, the Client should immediately download and maintain their own backup copies. After the applicable retention period expires, Shutter8 is not responsible for lost, deleted, corrupted, inaccessible, or unavailable images or files that the Client failed to download or back up. Shutter8 may retain certain Final Edits longer than twelve months at its discretion, but such additional retention is not guaranteed unless separately agreed in writing. 15. Gallery Expiration Notices Shutter8 may send reminder emails or text messages before a gallery expires. Failure to receive or open a reminder does not extend the storage period. The expiration date displayed inside the Client Gallery controls unless Shutter8 agrees to an extension. 16. Digital File Risks Although Shutter8 uses reasonable measures to protect digital files, no digital storage system can be guaranteed against every possible hardware failure, corruption, security incident, service interruption, or data-loss event. Where legally permitted, Shutter8's liability for loss of digital files shall not exceed the amount paid for the affected service. 17. Downloaded Files After the Client successfully downloads their final files, the Client becomes responsible for maintaining backups. Shutter8 strongly recommends storing files in more than one location. 18. Copyright Unless otherwise agreed in writing, Shutter8 retains copyright ownership of photographs, videos, designs, edits, and other creative works produced by Shutter8. Purchasing photography or videography services does not automatically transfer copyright ownership. Clients receive the usage rights included with their purchased package. 19. Personal Use Unless commercial licensing is included, Client photographs are licensed for normal personal use such as personal social media, printing for personal use, and sharing with friends and family. The Client may not sell, commercially license, substantially alter, or claim authorship of Shutter8's copyrighted work without written permission. 20. Commercial Use Images or videos created for businesses, brands, products, advertisements, campaigns, publications, or other commercial purposes may require commercial usage rights according to the purchased package or written agreement. 21. Portfolio / Promotional Usage Shutter8 may separately request permission to display selected work in its website, portfolio, social media, advertisements, promotional materials, competitions and publications. Where consent is required, this will be handled through an appropriate model release / media release rather than relying solely on these booking terms. A Client's refusal to grant promotional usage permission will not automatically cancel their paid service unless promotional use was specifically part of a separate written agreement. 22. Minors A parent or legal guardian must authorize services involving a minor when legally required. The adult making the booking represents that they have authority to consent on behalf of the minor when applicable. 23. Photo Booth For Photo Booth services, Shutter8 is not responsible for interruptions caused by circumstances outside reasonable control, including venue electrical failures, internet outages, guest misuse, venue restrictions, or unsafe conditions. Shutter8 may temporarily stop operation if continuing would risk injury or equipment damage. 24. DJ Services Clients requesting DJ services are responsible for providing accurate event details, venue information, schedule information, and reasonable access to electrical power and performance space where required. Song requests are requests only and are not guaranteed unless specifically agreed as part of the service. Shutter8 may refuse content or requests that would violate law, venue rules, platform restrictions, safety requirements, or another applicable obligation. 25. Videography Final video length, shot selection, music choices, editing style, and other creative decisions will follow the purchased package and agreed project scope. Additional footage, additional edits, alternate versions, or major post-production changes may require additional payment. 26. Editing Services The Client represents that they have the necessary rights or permission to provide Shutter8 with any photographs, graphics, videos, or other files submitted for editing. Shutter8 is not responsible for copyright or ownership disputes relating to materials supplied by the Client. 27. Client-Supplied Content The Client is responsible for the accuracy and legality of names, dates, logos, text, trademarks, photographs, music, and other materials they provide. Shutter8 is not responsible for errors that existed in Client-supplied information when Shutter8 reproduced that information as provided. 28. Equipment Failure / Emergency In the unlikely event of equipment failure, illness, emergency, severe weather, venue shutdown, natural disaster, or another circumstance reasonably outside Shutter8's control, Shutter8 may attempt to reschedule the service, provide a reasonable substitute, provide an alternate solution, or issue an appropriate refund where required. Shutter8 will not intentionally accept payment for a service it knows it cannot provide. 29. Unsafe or Abusive Conduct Shutter8 may immediately stop or refuse service when the Client, guest, attendee, or other person creates an unsafe, threatening, harassing, discriminatory, violent, illegal, or damaging environment. Depending on the circumstances and applicable law, termination for Client misconduct may not entitle the Client to a refund. 30. Damage to Shutter8 Equipment The Client may be responsible for repair or replacement costs when Shutter8 equipment is intentionally or negligently damaged by the Client or their guests, subject to applicable law. 31. Chargebacks & Payment Disputes Clients agree to contact Shutter8 regarding legitimate billing disputes before initiating a chargeback when reasonably possible. Initiating a chargeback does not automatically cancel contractual payment obligations or determine whether a charge was valid. Shutter8 may provide the booking agreement, payment records, communications, service records, delivery records, and acceptance records to the payment processor or financial institution when responding to a payment dispute. 32. Refunds Refund eligibility depends on these Terms, the purchased service, the reason for cancellation, work already performed, and applicable law. Non-refundable booking payments do not prevent Shutter8 from issuing a refund voluntarily when Shutter8 determines that circumstances warrant one. 33. Limitation of Liability To the fullest extent permitted by applicable law, Shutter8's total liability arising from a booking is limited to the amount actually paid by the Client for the service giving rise to the claim. Shutter8 is not responsible for indirect, incidental, special, or consequential losses where such limitations are legally enforceable. 34. Governing Law These Terms are governed by the laws applicable to Shutter8's business location and the transaction, without waiving any rights that cannot legally be waived. 35. Changes to Terms Shutter8 may update these Terms for future bookings. The version accepted at the time a Client completes a booking remains associated with that booking. 36. Electronic Acceptance By checking the acceptance box and completing the booking, the Client confirms that they have read these Terms & Conditions; that they understand the cancellation, deposit, rescheduling, file-retention, and payment policies; and that they voluntarily agree to be bound by these Terms & Conditions. Electronic acceptance has the same effect as signing the agreement to the extent permitted by applicable law. 37. SMS / Text Messaging Terms Shutter8 Media offers optional transactional text (SMS) messaging to customers who voluntarily opt in. SMS consent is requested separately during booking and is never pre-checked. By voluntarily opting in, the Client agrees to receive transactional text messages from Shutter8 Media relating to their bookings and orders. These may include booking confirmations, appointment reminders, scheduling changes, cancellation or rescheduling updates, payment and remaining-balance notifications, gallery or delivery notices, and other service-related updates. Message frequency varies and depends on the Client's own activity, bookings and orders. Message and data rates may apply. Charges are set by the Client's mobile carrier and are the Client's responsibility. Reply STOP to any message to unsubscribe at any time. Reply HELP for assistance, or contact Shutter8 Media using the details on the Contact page. Consent to receive text messages is NOT required to purchase or book any Shutter8 Media service. The Client may book, pay and receive service using email and phone alone. Opting out of SMS does not cancel an existing booking, order or account, and does not affect any other obligation under these Terms. Shutter8 may still contact the Client by email or phone about an active booking. The Client is responsible for providing an accurate mobile number and for notifying Shutter8 if that number changes or is no longer controlled by the Client. Carriers are not liable for delayed or undelivered messages.
